Please read these terms carefully before using our sustainability and ESG services

1. Acceptance of Terms

By accessing or using the sustainability and ESG services provided by Klock Aviation Limited ("Klock Aviation," "we," "us," or "our"), including our website, platforms, and consulting services, you agree to be bound by these Terms and Conditions.

If you do not agree to these terms, please do not use our services. Your continued use of our services constitutes acceptance of any updates or modifications to these terms.

2. Services Description

Klock Aviation's Sustainability & ESG division provides infrastructure and environmental solutions across Africa, including:

Smart Airport Operations

Workflow digitization, operational dashboards, and real-time ESG compliance systems for airport ecosystems.

Sustainability Advisory

Emissions mapping, decarbonization strategies, and renewable energy integration for aviation stakeholders.

Infrastructure Excellence

Energy optimization, green building technologies, and waste management automation for airports.

ESG Services

Carbon accounting, emission modeling, green financing, and regulatory compliance solutions.

3. Consulting Engagements

  • All consulting engagements are subject to a signed statement of work (SOW) outlining scope, deliverables, and timelines.
  • A deposit may be required to commence work. Payment terms will be communicated at the time of engagement.
  • Final deliverables remain the intellectual property of the client upon full payment, unless otherwise agreed in writing.
  • Proposals and quotes are valid for 30 days unless otherwise specified.

4. Cancellation & Refund Policy

Cancellation fees may apply based on the stage of the engagement:

Before project commencement

Full refund minus administrative fees

During discovery/analysis phase

50% of the total engagement amount

After deliverables have been submitted

No refund available

Note: Cancellation policies for ongoing retainer agreements may vary based on the specific terms of each contract.

5. Client Responsibilities

  • Clients must provide accurate and timely data, documentation, and access required for the delivery of services.
  • Clients must comply with all applicable environmental regulations and reporting requirements in their jurisdiction.
  • Confidential information shared during engagements must not be disclosed to third parties without written consent.
  • Clients are responsible for implementing recommendations at their own discretion and risk.

6. Limitation of Liability

Klock Aviation's liability is limited to the extent permitted by applicable law. We shall not be liable for:

  • Outcomes of ESG strategies or sustainability initiatives that depend on external factors beyond our control.
  • Regulatory changes that may affect the applicability of our recommendations after delivery.
  • Indirect, consequential, or special damages arising from the use of our services or reports.

Our total liability shall not exceed the fees paid for the specific engagement giving rise to the claim.

7. Intellectual Property

All content on our website and platforms, including logos, text, images, methodologies, frameworks, and software, is the property of Klock Aviation Limited or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms and Conditions. We comply with the Kenya Data Protection Act, 2019 and applicable international data protection standards including GDPR where applicable.

By using our services, you consent to the collection and processing of your personal data as described in our Privacy Policy.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise agreed through arbitration.

10. Changes to Terms

Klock Aviation reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes indicates your acceptance of the modified terms.

Acknowledgment

By using the services provided by Klock Aviation, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with these Terms, you must immediately stop using our Services.
